LU defends decision to close Plaza
Liberty University is standing by its decision to deny parking for Wednesday night’s Obama event, a move that’s drawing criticism from local Democrats.
City officials, meanwhile, are looking to Sen. Barack Obama’s campaign to pay for a last-minute shuttle service established to get attendants from City Stadium to the rally at E.C. Glass High School.
The city stepped in after learning Wednesday morning LU would not allow event parking at The Plaza shopping center.
On Thursday, Liberty officials said they did make an offer to supply the Obama campaign with paid — not free — parking at the shopping center, which is owned by the university.
No reply was received, according to administrators.
LU Chancellor Jerry Falwell Jr. said that after initially declining to allow parking, the school was asked by the Secret Service to reconsider. Liberty then agreed to rent parking to the campaign at fair-market value, which it determined was between $5 and $10 per space.
“We said we would try to clear it with (the businesses in The Plaza) and see what was available,” Falwell said. “… We tried to accommodate them.”
LU, a registered 501(c)(3), said its tax-exempt status prohibits it from providing free parking to a political rally. Federal law bars exempt groups from contributing to political campaigns either directly or indirectly, according to the Internal Revenue Service’s Web site.
A spokesman for the IRS declined to discuss what would or would not constitute a violation of those rules, saying such decisions must be made on a case-by-case basis.
Falwell said supplying free parking would have amounted to donating the cost of the space to the Obama campaign, in violation of federal tax code.
LU has been criticized by some, particularly among Obama supporters, for closing off access to The Plaza.
The chairman of the local Democratic Party, John Lawrence, said Thursday the school was “making up excuses” to avoid helping a Democratic candidate.
“They did it to spite the Obama campaign,” he said.
Falwell said the university would have taken the same action with any public event, political or otherwise, that sought to use its property without permission.
“It doesn’t surprise me people are upset, but they should be upset with the Obama campaign for not working it out beforehand,” he said.
Organizers of Obama’s appearance at E.C. Glass initially directed ticket holders to park at The Plaza without the school’s knowledge.
Falwell said he only learned of the situation through television reports the night before.
A campaign spokesman operating out of Richmond confirmed Thursday that no one sought the school’s permission before announcing the arrangements.
“My understanding is some of our staff thought it was public parking,” said Kevin Griffis. “Once we were told it was not public, we told people not to park there.”
Griffis also said he didn’t believe the campaign was given the option of paid parking, but added such events usually rely on free, public spaces.
It was not immediately clear if LU’s offer was relayed to Obama officials. LU provided the name of the Secret Service agent it spoke with. He in turn said only that the agency does not pay for parking.
Further questions were referred to the agency’s Richmond office, which had already closed for the day as it was after business hours.
The Obama camp may still end up paying for at least a portion of last night’s parking costs.
The city intends to send them a bill for a shuttle service it quickly established after learning there would be no Plaza parking.
The city encouraged rally attendants to park at City Stadium, where six school buses awaited to ferry them to E.C. Glass and back. Officials said they were concerned a dearth of parking would create confusion and lead to a possible public safety hazard.
The cost of the shuttle service was not immediately known, but City Manager Kimball Payne said on Thursday that the city did expect the campaign to pay for it.
“The Obama campaign was told yesterday it would be sent a bill,” Payne said. “They created this situation. They coordinated it. … We don’t feel it was our responsibility to manage the parking.”
The city does not plan to seek reimbursement for other support services provided, including the presence of more than 40 local police officers.
Payne described these other forms of assistance as “customary” support that would be provided to any visiting dignitary.
“If John McCain comes, we’ll do the same for him,” he said.
The total cost to the city for the Obama event is not yet known, but will be compiled. Payne predicted it wouldn’t exceed five figures.
Griffis, of the Obama campaign, was not aware of any pending bill, but said he imagined if the city did provide parking it was in an effort to support a positive event in the community.
“Obviously, it did bring a lot of positive attention to Lynchburg,” he said of the rally, which was attended by more than 2,000 people.
Payne said while the campaign has not expressly agreed to pay, he expected it would.
“I’m assuming they’re honorable people,” he said.

LU was well within their legal rights to close down parking at the Plaza. I don’t think there is any doubt about that, but LU/TRBC was not acting in the best interests of the community or the city of Lynchburg and was not following Christian precepts by doing so. They are setting a very poor example for Christians by acting in such a duplicitous and non-civic-minded way. WWJD?
the brainwashed cult that will defend LU and TRBC is just amazing to me, anything that a falwell says is gold to them and must be the truth of what happened, please Jerry Jr is about as idiotic as his father from recent statments he has been making. they have never been afraid of abusing their tax exempt status, all you had to do in the past was attended a service to hear about how bad democrats are from Sr. like it was some moral sin, and as said before buying property in the name of the church or school so they can’t be taxed for it, and then selling it to retailers for tons of money that the city can’t touch. i see that they dropped the argument that they were scared if an accident occured on their property…well if that was the case what do they do when someone has an accident over at the movie theathre, or the other two stores that do business there? guess they need to shut them down huh, or start selling parking spaces to them. your right private property is private property, so LU kids and TRBCers should respect that fact to if they are going to shut down a parking area with the all mighty LUPD (ha) they in turn need to stay off others when they want to attend LU or TRBC activities, just more to show you the disgusting people that attend these services, give me give me give me, but no we owe nothing, and the amazing phrase, but I go to Liberty when they get in trouble, like that means something. Perhaps if the Secret Service could have hired collectors to stand at each entrance of the plaza with collection plates to support the ongoing efforts of the Falwells to control the ins and outs of your fair city then there would have been a much different outcome. As for LU I think the motif on the hill when you enter the city is an eyesore. Of course, there would never be any negative press concerning that. As for a highway and/or street being named after Jerry Falwell that is a joke. Carl Hutcherson is more desiring of that than the bootlegging Falwells!!
I don’t understand the criticism of liberty in this matter. The plaza is private property and the Obama campaign more or less tried to appropriate it for their own use. Private property is private property regardless of who owns it and I doubt anyone who complains of Libertys actions would be so indifferent to the rights of property owners if it was there driveway that was in question.
Two simple and good lessons from this “controversy” - In the future the owners of the Plaza will be consulted as part of any plans for overflow parking during events at E.C. Glass high school - as it should be and should have been. And the city will get out of the business of arranging parking for political rallies.

Let’s use some reasoning skills.
Liberty says they couldn’t give free parking because of federal tax law.
Liberty critics say that Liberty shouldn’t park at Toys R Us and Dollar Tree.
Now, correct me if I’m wrong, but a) Toys R Us and Dollar Tree are not registered 501(c)(3) organizations, and b) Liberty is not a political candidate for president. That would mean that the only reason Toys R Us or Dollar Tree would close their parking lots would be because of an inconvenience, not because they could get in hot water legally.
Also, some of you do not realize the difference between Liberty and Thomas Road. Jerry Falwell, Sr started both of these and until his death, he was leading both of them. However, when he passed away, the school began being run by Jerry Jr and the church by Jonathan. Liberty University events have no need to park at Dollar Tree and Toys R Us. Thomas Road events do. Don’t blame Liberty for something Thomas Road does now. The two may be affiliated but they are definitely not the same.
Putting hatred aside and looking at the facts at hand is a great skill to have. I recommend it to everyone.

not to seek accumulating the “worldly” wealth. At present Liberty University and a lot of you blogging here are being shamefully partisan and Mean! There’s a Pharoah like mentallity that demands that all who enter the city Kneel at the feet of our shameful past of intolerance & arrogance. How Christian peoples can now be so politically nuanced I don’t understand. On politics Jesus was clear. One thing that is Clear here is the Roots of Tradition in Lynchburg is far reaching and unchanged after all these years. I am ashamed of my beloved city and it’s leaders.
Actually, Liberty University is not bound by IRS laws prohibiting the support of any political campaign as seen by their having Huckabee, McCain and Bush speak at the university.
Only TRBC would be held accountable and, as a non-profit organization, they do not own the Plaza and would not be allowed to charge anyone anything for the use of those parking spaces. Once again the Falwells are being disingenuous and putting their own needs ahead of the community’s. I would expect better from Christians.
Cubic, I agree with you. Granted, LU did not have to allow parking in their lot, but it would have shown that they could be “neighborly.‘
