State legislators may file up to 15 bills during each session of the General Assembly. Here are the bills filed in 2009 by five Lynchburg-area legislators. Click a bill's name to see its current status.
Del. Watkins Abbitt, I-Appomattox
HB2168 Stormwater offsets. Authorizes permit-issuing authorities to allow developers and others holding stormwater permits to comply with nonpoint nutrient runoff criteria by either (i) acquiring offsite nonpoint nutrient offsets that have been certified under the Chesapeake Bay Nutrient Exchange Program or (ii) through water quality measures contained in a regional stormwater management plan. The offsets have to be in the same tributary as the permitted activity.
HB2169 Board of Towing and Recovery Operators. Repeals the chapter that established the Board of Towing and Recovery Operators. Removes the requirement that the advisory board of a local governing body include towing and recovery operators who are licensed.
HB2390 Agents of the Alcoholic Beverage Control Board. Designates as agents of the ABC Board any licensed distiller who blends alcoholic beverages on his licensed premises and meets other requirements. The bill defines the term "blended." It would apply to a proposed distillery in Nelson County.
HB2624 Training of private correctional personnel at Lynchburg Criminal Justice Training Academy. Allows the academy to agree to train private correctional personnel employed by the Immigration Centers of America-Farmville, provided the academy is reimbursed for the costs of such training.
HB2625 Emergency medical services provider complaints. Provides that a copy of a complaint regarding an emergency medical services provider shall be given to the provider. This bill provides that no EMS provider shall be interviewed as part of the investigation process until he or she has been properly notified of the complaint, and that failure to provide the notification shall entitle the EMS provider to recover damages of $25,000 plus costs and attorney fees.

HB2124 Landlord and Tenant Act; early termination of rental agreement with military personnel. Provides that when a tenant qualifies to terminate a rental agreement based on discharge from duty or military orders that change the duty station, the termination is effective 30 days after written notice is provided by the tenant.
HB2125 Planning or zoning notice by applicant. Allows a locality to require that a person applying to the local governing body, planning commission or board of zoning appeals for a planning or zoning matter shall post a sign notifying the public of the place and time of the public hearing regarding his property. The locality shall specify information to be on the sign, its size, and placement.
HB2126 Businesses employing illegal aliens. Tightens requirements for cancelling the Virginia registration of businesses that are convicted of violating federal law for employing unauthorized aliens. The measure has an emergency clause and would become effective on April 1, 2009.
HB2127 Minors' bank accounts. Authorizes banks to establish deposit accounts for minors, in which accounts minors will be the sole owner and may make deposits and withdrawals. The measure is similar to such accounts at savings institutions.
HB2437 Corporate income tax for manufacturers. Allows manufacturers to choose a tax apportionment formula based on their sales factor, or based on the formula prescribed for other businesses, whether the manufacturers have a sales factor or not. The provisions would be effective July 1, 2010, and be phased in to become a 100 percent sales factor by 2013.
HB2558 Biosolids permit. Clarifies that if a biosolids permit is amended to increase the acreage by 50 percent or more than was permitted in the initial permit, public notice shall be given and a public meeting shall be held.
HB2579 Ultrasound required before abortion to determine gestation age. Requires that, as a component of informed consent to an abortion and determination of gestation age, every pregnant female shall be given the opportunity to view an ultrasound image of her fetus prior to the abortion.
HB2626 Line of Duty Act; investigation of claims by police departments and sheriffs offices. Provides that when a police department or sheriff's office is the last employer of a deceased or disabled person, the department may investigate the circumstances surrounding the deceased or disabled person and report the findings to the state Comptroller. Currently all investigations must be conducted by the State Police.
HB2649 Solid waste report. Removes the requirement that the Department of Environmental Quality include in its annual solid waste report an estimate of the amount of solid waste managed or disposed of through recycling. The bill sunsets in two years.

HB2285 Searchable database website of state budget expenditures and revenues. Would create and maintain a searchable database website containing information on state revenues, appropriations, and expenditures. A pilot searchable database website would be available for public use no later than July 1, 2010.
HB2286 Procurement of services by state agencies. Requires each state agency, except law-enforcement agencies, to obtain nonprofessional services from the private sector if those services are listed by the Commonwealth Competition Council.
HB2287 Budget submissions to the General Assembly. Requires the state Department of Planning and Budget to include General Assembly members when it provides all agency budget estimates to the governor, including an analysis of such estimates for the deliberative use of the Governor and the General Assembly.
HB2288 Eligibility for employment with community services board. Removes provision allowing the board to employ a person convicted of assault and battery of a family member.
HB2289 Duty to inform commissioner of the revenue about property in self-storage and other facilities. Requires (i) entities that manage real property and maintain names of the owners of such property to provide such names to the commissioner, and (ii) the owner or manager of a self-storage facility to provide the names and addresses of the lessees of any portion of the facility's common area.
HB2290 Income tax credit for animal adoption. Allows a credit to individuals who adopt animals from pounds or nonprofit shelters equal the adoption fee or $100, whichever is less.
HB2291 Release of deed of trust; penalty. Prohibits settlement agents and real estate attorneys from assigning to themselves their client's right to the $500 penalty levied on lenders who fail to timely deliver a certificate releasing a deed of trust.
HB2292 Workers' Compensation Act; insurance notices. Authorizes the Workers' Compensation Commission to designate an agent to receive state-required insurance-related notices from an employer, insurance carrier, or insurance association. The measure would take effect upon passage.
HB2441 Powers and duties of the Director of the Department of Corrections. Ensures that the attorney for the Commonwealth is notified of an inmate's membership in a gang by the Director when the attorney for the Commonwealth is prosecuting that inmate for an offense committed while in prison.
HB2633 Assault and battery on a campus police officer. Adds campus police officers to the list of officers who, when victims of assault and battery, subject the perpetrator to enhanced punishment, a Class 6 felony instead of a Class 1 misdemeanor.
HB2634 Unborn child pain information. Requires doctors to offer to anesthetize a fetus prior to abortion and to include in informational materials a statement that a fetus at 20 gestational weeks has the physical structures necessary to feel pain and react to physical stimuli in a manner that, in an infant or adult, would be interpreted as a response to pain.
HB2635 Publication of information contained in local warrants. Authorizes local governments to publish information relating to bills paid by the locality. The billing information that could be published would be the names of payees, amounts paid, the serial numbers of payment warrants, and dates of payments.
HB2636 Special hunting and fishing license for youth groups. Authorizes the issuance of a special group hunting and fishing license to a nonprofit wildlife education organization that takes youth on hunting and fishing excursions.
HB2637 Arrests for which fingerprints are required. Requires that fingerprints be taken and forwarded to the Central Criminal Records Exchange upon an arrest for a violation of a protective order issued under Title 16.1.

HB1600 The state budget bill. Adjustments for a revenue shortfall of at least $2.9 billion for fiscal 2009-10 are being considered.
HB1604 Revenue bonds; new parking deck. Authorizes the Treasury Board to issue bonds under Article X, Section 9 (c) of the Constitution of Virginia up to $16 million plus financing costs to build a parking deck in Richmond at Seventh and East Franklin streets to serve a state office building.
HB1662 Revenue bonds; Virginia Tech. Authorizes the Treasury Board to issue bonds under Article X, Section 9 (c) of the Constitution up to $10 million to renovate Ambler Johnston dormitory at Virginia Tech. The bill is effective upon passage.
HB2487 Transition of city to town status; library aid. Increases from five years to 15 years the period in which cities that transition to town status may continue to receive library aid from the state government.
HB2575 Corporate income tax; major business facility job tax credit. Extends the sunset date of the major business facility job tax credit from January 1, 2010, to January 1, 2020, and allows the credit to be taken over a two-year period rather than a three-year period for taxable years beginning January 1, 2009, through December 31, 2010.
HB2660 Capital outlay plan; Governor's proposal. Constitutes the Governor's statutorily required proposal of a six- year capital outlay plan for projects to be funded entirely or partially from general fund-supported resources.

HB1684 Retired nurses could be hired. Provides that retired persons who are members of the Virginia Retirement System may be hired as nurses without interrupting their retirement benefits under certain conditions.
HB1685 Bipartisan Redistricting Commission. Would establish a temporary commission to prepare redistricting plans in 2011 and each tenth year thereafter for the House of Delegates, state Senate, and congressional districts.
HB1735 Arts and cultural districts. Grants statewide authority for creation of arts and cultural districts by localities for the purpose of increasing awareness and support for the arts and culture in the locality. Currently, only certain localities can create arts districts.
HB2234 Darfur genocide measure. Would prohibit companies that have business operations in Sudan from bidding on contracts with state agencies. Would list criteria related to the genocide in the Darfur region of Sudan that would make entities ineligible to bid upon or propose goods, services, or construction to state public bodies.
HB2235 Clean Energy Manufacturing Incentive Grant Program. Would apply to companies that begin or expand projects to manufacture or assemble equipment, systems, or products used to produce renewable energy, nuclear energy, or energy efficiency. Originally proposed by Gov. Timothy M. Kaine in the state budget bill with a $5 million appropriation.
HB2236 Private security officer nomenclature. Changes the words "private security guard" to "private security officer" in three sections of Title 46.2
HB2237 Improper printing of credit card numbers. Provides a civil penalty of not more than $1,000 per violation for the willful inclusion of a credit card number on a printed receipt.
HB2238 Transport of hazardous materials after out-of-service order. Extends disqualification for violation of an out-of-service order to any person operating a commercial vehicle used to transport hazardous materials.
HB2239 Compulsory training standards for courthouse and courtroom security personnel. Allows persons who provide courthouse security, and previously were certified and served as law-enforcement officers, to meet reduced training standards. Persons who were terminated for cause are not included.
HB2240 Virginia Economic Development Partnership Authority; board of directors; powers. Authorizes ex officio members of the board of directors of the Virginia Economic Development Partnership to designate an individual to serve.
The bill also authorizes the Authority to offer a program to issue export documentation for a company that exports goods and services if no federal agency or other regulatory body or issuing entity will provide such documentation. This would apply to exports by the C.B. Fleet company in Lynchburg.
HB2241 Detector canine handlers and examiners. Provides that the Department of Criminal Justice Services regulations may provide for partial exemption from compulsory entry-level training for detector canine handlers and examiners who have been employed in a unit of the U.S. Armed Forces Military Working Dog (MWD) program. The bill also provides that the Private Security Services Advisory Board membership shall include two representatives of detector and security canine businesses.
HB2542 “Move-over" law. Expands the group of stationary vehicles for which motorists must, if safe to do so, move to the left. Police vehicles, fire trucks and ambulances would be included.
HB2543 Campaign fundraising; special sessions. Requires that contributions greater than $500 received by members of the General Assembly, the governor, the lieutenant governor, and the attorney general during special sessions of the General Assembly be reported to the State Board of Elections or local electoral board within 24 hours.
HJ714 Study by JLARC of passenger and freight rail programs. Directs the Joint Legislative Audit and Review Commission (JLARC) to study the state's passenger and freight rail funding needs and suggest possible funding sources.

SB1277 Land records; social security numbers. Requires, beginning July 1, 2012, that social security numbers not be contained in land records posted via secure remote access to the Internet
SB1278 Individual income tax; school supplies expense tax credit. Provides an income tax credit effective Jan. 1 equal to 100 percent of the amount paid by a taxpayer for school supplies for use by students in public or private primary or secondary schools or students being home schooled.
SB1279 Virginia Economic Development Partnership Authority; board of directors; powers. Authorizes ex officio members of the board of directors of the Virginia Economic Development Partnership to designate an individual to serve.

SB1281 Advertising structures. Provides that the prohibition on advertising structures within 660 feet of any "parkway" does not apply to the Jerry Falwell Parkway, designated by Chapter 44 of the Acts of Assembly of 2008.
SB1282 Information concerning health professionals. Prohibits the Department of Health Professions from providing a list of home addresses and other personal information of individuals licensed as health professionals to any private entity for resale to another private entity or the public.
SB1283 Fuels taxes; change in tax basis. Replaces $0.05 per gallon of the current fuels tax on gasoline, gasohol, and diesel fuel with a cents-per-gallon tax equal to 5 percent of the statewide average wholesale price of a gallon of self-serve unleaded regular gasoline. The change to the fuels tax rate would only occur if the statewide weekly average wholesale price of a gallon of self-serve unleaded regular gasoline falls below 99 cents per gallon.
SB1284 Compulsory training standards for courthouse and courtroom security. Allows persons designated to provide courthouse security who have previously been certified and served as law-enforcement officers, other than a person terminated for cause, to meet reduced minimum compulsory training standards.
SB1285 Publication of annual school budget. Requires local governing bodies and school divisions to publish the estimated required local matching funds in the publication of the annual school budget.
SB1286 Department of Health; certificates of free sale. Extends until July 1, 2010, the authority of the Department of Health to issue certificates of free sale to the manufacturer of any product defined as a "cosmetic" in the Federal Food, Drug and Cosmetic Act, to allow the export of such products. This applies to the C.B. Fleet Co. in Lynchburg.
SB1287 Annexation. Extends the current moratorium against cities annexing adjacent land from counties to 2018.
SB1288 Parkway. Provides that the term "parkway" in the Code of Virginia does not include any parkway designated by the General Assembly in 2008.
SJ349 Constitutional amendment (first resolution); property tax assessments. Authorizes localities to cap the annual increase in assessed values of real estate at no more than 25 percent, or a greater percentage set by the ordinance. The real estate will be reassessed at fair market value in the year in which it is sold, improved, or otherwise changes hands.
