The investigation of a shooting in a Madison Heights shopping center on Friday that left a man in critical condition and a deputy on administrative leave is now waiting on ballistics and other lab tests to move forward.
Mack S. Berkley, 68, of Lynchburg, will face one count each of conspiracy to distribute cocaine and one count of possession of cocaine with the intent to distribute when he is released from Lynchburg General Hospital.
He was listed in critical condition following the shooting.
The incident happened on Friday just before 3 p.m. when a deputy fired into a vehicle in front of the Food Lion in the Amelon Square Plaza on U.S. 29 Business, near Virginia 130. The car, which sat close to the store’s entrance had two bullet holes in its windshield.
The identity of the Amherst County deputy involved in the shooting has not been released, nor have many other details of the incident, including why Berkley and the deputies were in the parking lot and what happened that resulted in gunfire.
The identity of the other person in the car with Berkley is not being released.
No one else was injured.
The deputy is on administrative leave pending the outcome of an internal investigation — a routine procedure, said Lt. G.L. Turner, of the Amherst County Sheriff’s Office.
Botetourt County Commonwealth’s Attorney Joel Branscom has been appointed as the special prosecutor after Amherst County Commonwealth’s Attorney Stephanie Maddox recused herself from the case.
A search of court records relating to Berkley in Lynchburg revealed two convictions in 1996. One was for cocaine possession and the other for possession of a firearm while in possession of a controlled substance. For that, Berkley served three months in jail.
