Virginia Attorney General Bill Mims says his office will rewrite the state’s anti-spam law to address constitutional concerns.
The U.S. Supreme Court refused on Monday to review a lower court’s ruling that the law was unconstitutional.
The Virginia Supreme Court struck down the law in September because it barred political, religious and other messages along with commercial solicitations.
Mims says his office will draft legislation for the 2010 General Assembly session that addresses the constitutional concerns.
Virginia’s law was challenged by Jeremy Jaynes. Jaynes bombarded Internet users with millions of pieces of spam, all of it commercial.
Jaynes’ attorney, Thomas M. Wolf, says he’s not surprised that the nation’s highest court refused to consider the case.
