A former executive director of Sunset Cay at Smith Mountain Lake has been charged with four felonies, and at least three civil lawsuits have been filed against developers seeking money owed.
Jim Fields, whom federal court papers claim was the executive director, has been charged with four counts of felony embezzlement in Bedford County General District Court. Investigators accuse Fields of collecting taxes for meals and other sold items, then failing to hand the money over to state and local authorities.
An $8.3-million dollar lien has been filed against Sunset Cay developers in U.S. District Court. Wachovia claims developers have failed to pay back the loan, and it wants a judge to declare it default.
A company contracted to handle restaurant and uniform supplies at Sunset Cay’s restaurant and motel has also sued developers in Bedford County Circuit Court for more than $300,000. The company, Alsco Incorporated, claims Sunset Cay broke its contract by not paying for services since May 2007.
Another construction company, Gantt Construction in Lynchburg, has also sued for money it claims developers owe them from the marina, restaurant, and motel renovation project.
The marina, restaurant, and motel appear to be closed. A “no trespassing” sign is clearly visible on a gate preventing drivers from reaching the resort.
Fields could not be reached for comment.
He is due in court for a preliminary hearing on June 8th.
