Second phase delayed in landfill pollution trial

RUSTBURG — The second phase of a landfill pollution trial that had been scheduled for Friday was delayed.

A jury granted a $9 million judgment against Campbell County during the first phase of the civil trial, which concluded late last month after nine days.

As of Friday morning, the case had not been rescheduled, according to the clerk’s office.

The October judgment was in favor of landowners Claude “Butch” and Virginia Royal. The Royals own and operate the 160-acre Twin Oaks manufactured home park near Yellow Branch. They sued the county in 2005 and 2006 after a study found chemi-cals were leaking from the adjacent county landfill into their groundwater.

Judge Michael Gamble ruled in September that the county was responsible for polluting the water. Jurors had been expected to meet Friday to consider awarding fees to the Royals.
